Jim Kelly obtained a defense verdict in favor of Hunter Mountain in a jury trial in New York Supreme Court, Greene County on July 18, 2024. The case was titled Avrohom Grafstein v. Hunter Mountain Ski Bowl, Inc. and was tried before Hon. Richard Mott.
Plaintiff suffered fractured displaced humerus of right shoulder while skiing at Hunter Mountain on January 4, 2019. Plaintiff contended that intermediate ski trails were closed compelling him to ski a black diamond trail, Hellgate. While on Hellgate he fell and suffered injury. Defendant contended plaintiff assumed the inherent risks of skiing. Defendant’s motion for summary judgment was denied and the denial was affirmed on appeal by the Appellate Division, Third department.
The jury returned a verdict in favor of Hunter Mountain after deliberating for one hour.
